Terms and Conditions

These Terms & Conditions govern your use of the CMS Corequip website and your purchase of goods from us. By using this website or placing an order, you agree to these terms. In these terms, 'we', 'us', 'our' and 'CMS Corequip' mean CMS Asia Pacific Pty Ltd ABN 56 679 041 680 trading as CMS Corequip.

These terms cover direct sales of our own stock. Sales of third-party surplus equipment through our marketplace are governed by our separate Marketplace Terms.

1. Orders & acceptance

Placing an order is an offer to buy. A contract forms only when we accept your order by confirming dispatch or by written acceptance. We may decline or cancel an order at our discretion, including where an item is out of stock, incorrectly priced, or where we cannot verify your details. If we cancel a paid order, we'll refund you in full.

2. Pricing & GST

Prices are in Australian dollars. Prices are shown exclusive of GST; GST is added at checkout. We may change prices at any time before we accept your order. Obvious pricing errors are not binding on us.

3. Payment

We accept the payment methods shown at checkout. For invoiced or EFT orders, goods are dispatched on receipt of cleared funds. Title in goods remains with us until payment is received in full. Risk passes on delivery to you or your carrier.

4. Delivery

Delivery timeframes are estimates, not guarantees. We're not liable for delays outside our reasonable control. See our Shipping & Returns page for details.

5. Returns & consumer guarantees

Our returns policy and your rights under the Australian Consumer Law are set out on our Shipping & Returns page and form part of these terms. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the ACL that cannot lawfully be excluded.

6. Limitation of liability

To the extent permitted by law, and except for liability that cannot be excluded under the ACL, our total liability to you for any claim arising from these terms or a purchase is limited, at our option, to resupplying the goods or paying the cost of resupply. We are not liable for indirect or consequential loss, including loss of profit, production, or downtime.

7. Product information

We take care to describe goods accurately, but specifications, images, and descriptions are provided as a guide. Where fit, compatibility, or application is critical, confirm with us before ordering. Slight variations in dimensions, finish, or supplier may occur.

8. Intellectual property

All content on this website — text, images, logos, and design — is owned by or licensed to CMS Asia Pacific Pty Ltd and may not be copied or used without our written permission.

9. Governing law

These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.

10. Changes to these terms

We may update these terms from time to time. The version published on this website at the time you place an order applies to that order.
